Tradexpress tea break competitions and puzzles - Issue 10 terms and conditions

  1. The Promotions will run from 01 December 2010 to 31 January 2011.
  2. The Promotions are the Caption Competition, Spot the Product and What Is It?
  3. Entries must be received by text or e mail as set out in clauses 5 to 7 no later than close of business on 31 January 2011.
  4. The Promotions are open to all residents of the United Kingdom (including Northern Ireland, the Channel Islands and the Isle of Man) and the Republic of Ireland aged 18 or over (the "Participants"), and exclude employees of the Imperial Chemical Industries Limited group of companies and their families, agents, or anyone connected with these Promotions.
  5. To participate in the Caption Competition, Participants need to text the word CARTOON and their suggested caption with their full name, town and postcode to 07781 474422 or email tradexpress@duluxtrade.co.uk.
  6. To participate in Spot the Product, Participants need to text the word PRODUCT and their answer with their full name, town and postcode to 07781 474422 or email tradexpress@duluxtrade.co.uk.
  7. To participate in What Is It? Participants need to text the word WHAT and their answer with their full name, town and postcode to 07781 474422 or email tradexpress@duluxtrade.co.uk.
  8. NO PURCHASE NECESSARY. Entry is free but Participants should be aware that they may be subject to charges depending on their own individual arrangements for Internet access. The cost of sending a text will be at the Participants' standard mobile network tariff.
  9. There are three prizes of £30 worth of leisure vouchers, one set for each of the Caption Competition, Spot the Product and What Is It? (the "Prizes").
  10. The prize provider is Acorne Plc (trading as Leisure Vouchers), Acorne House, 9 Lane End Business Park, Lane End, High Wycombe, HP14 3BY (the "Prize Provider").
  11. InThe draw will take place on 14 February 2011 (the "Draw") for each of the Promotions. For the Caption Competition, the winner will be the best caption selected by an independent judge from all entries submitted in accordance with these terms and conditions. For the Spot the Product and What Is It? the winner will be drawn at random by an independent person from all correct entries received by the closing date.
  12. The Promoter accepts no responsibility for entries that are incomplete, illegible, damaged or lost. Proof of submission of an entry is not proof of receipt.
  13. Only one entry per Participant for each of the Caption Competition, Spot the Product and What Is It? will be permitted.
  14. No third party or joint submissions will be accepted.
  15. In the event of any dispute, the decision of the Promoter and its appointed representatives shall be final and no correspondence shall be entered into.
  16. The prize-winners will be notified in writing within 28 days of the closing date. If any prize winner is unable to be contacted after a reasonable period of time, a replacement winner may be drawn at the Promoter's discretion.
  17. Details of the prize-winners will be available after 14 February 2011 by sending a stamped addressed envelope to the Promoter's address below entitled "TradeXpress Tea Break Competitions"
  18. By entering these Promotions applicants agree to be bound by these terms and conditions.
  19. The Prizes are subject to availability and the Promoter reserves the right to substitute a prize of similar value in the event that the original Prizes offered are not available due to circumstances beyond its reasonable control. No cash equivalent or alternative will be provided for any Prizes awarded under the Promotions and Prizes are not redeemable for cash.
  20. The Prizes are non-transferable and cannot be used other than by the person named on the leisure voucher.
  21. The Prizes will be subject to the terms and conditions of the Prize Provider. The Prizes can be used at locations specified by the Prize Provider.
  22. Travelling expenses to and from the leisure facility chosen by the prize winner to use their vouchers will be the prize winners' responsibility, as will any incidental expenses.
  23. The Promoter accepts no responsibility for lost, damaged or stolen leisure vouchers.
  24. The Promoter reserves the right, with or without cause, to exclude any Participant in these Promotions or withhold any prize where there has been a violation of any of these terms and conditions.
  25. Data Protection: The Promoter is committed to protecting the privacy of Participants. Any information that is collected from Participants in connection with these Promotions will only be used by the Promoter or its agents for the purposes of marketing or administering these Promotions and future promotions or publicity material relating to these Promotions.
  26. The Prizes cannot be used in conjunction with any other offers or promotions.
  27. The winner may be asked to participate in future publicity or PR activities including having photographs taken and the publication of those photographs. By participating in the Promotion participants agree to participate in future publicity.
  28. By participating in these Promotions, Participants acknowledge and agree that certain personal data relating to them (including their name and geographical area) may be disclosed to third parties.
  29. The Promoter reserves the right to amend or withdraw the Promotion in whole or in part temporarily or permanently, without prior notice or compensation.
  30. To the fullest extent permitted by law, the Promoter excludes:
    1. all conditions, warranties and other terms which might otherwise be implied; and
    2. any liability for direct, indirect or consequential loss or damage incurred by any person in connection with the Promotions. This shall not be deemed to exclude or restrict liability for death or personal injury resulting from the negligence of the Promoter, its employees or agents.

TradeXpress - Horror Stories - Issue 10 - Terms and Conditions.

  1. The Promotion will run regularly in TradeXpress until the Promoter decides to withdraw the Promotion.
  2.   6. By entering, all eligible Participants agree to abide by each and all of these terms and conditions. The Promoter reserves the right, with or without cause, to exclude Participants and withhold any prize where there has been a violation of any of these terms and conditions.
  7. Each Participant must submit their story with their name, address, contact telephone number and location by email to tradexpress@duluxtrade.co.uk or by post to the Promoter's address below. The story should be the Participant's own and Participants represent and warrant that their entry does not infringe the privacy rights, copyright or any other rights of any person.
  8. To be considered for publication any contribution must be within the defined scope of TradeXpress feature.
  9. Only stories in the English language can be accepted.
  10. The Promoter is under no obligation to publish any contribution.
  11. All contributions will be checked for suitability. The Promoter reserves the right to reject contributions on the grounds of copyright infringement, defamation, offensiveness or other legal considerations.
  12. The Participant will be notified in writing within twenty eight (28) days of receipt by the Promoter of their entry if their story is being considered for publication in TradeXpress.
  13. The Promoter will edit the Participant's story before publication and then submit to the Participant for final approval. No stories will be published before the Participant has agreed in writing that it can be published.
  14. The Participant grants permission for their contribution to be edited for publication in accordance with Clause 12.
  15. The Participant warrants that their submission is their own original work or that written permission has been received from a third party owner to use any other material and that the Participant has the right to submit the contribution for publication in TradeXpress. The rights of third parties including copyright, trademark, privacy, or proprietary rights must not be infringed.
  16. The Participant indemnifies the Promoter against all legal fees, damages and other expenses that may be incurred as a result of their breach of the above warranty.
  17. The Participant, by submitting a contribution, agrees to grant the Promoter a perpetual, royalty-free, non-exclusive, sub-licensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, make available to the public, and exercise all copyright and publicity rights with respect to their contribution worldwide and/or to incorporate your contribution in other works in any media now known or later developed for the full term of any rights that may exist in their contribution. If the Participant does not want to grant to the Promoter the rights set out above, the Participant should not submit their contribution.
  18. The Participant agrees that the Promoter shall not be responsible for any third party infringements of their rights in the contribution, copyright or otherwise, which may result from its publication in TradeXpress or its use in publicity material.
  19. All contributions published will receive £30 worth of leisure vouchers within 28 days of publication (the "Prize"). The Prize is subject to availability and the Promoter reserves the right to substitute a prize of a similar value in the event that the original Prize offered is not available due to circumstances beyond its reasonable control.

  21. There is no cash or other alternative to the Prize stated and the Prize is not transferable and cannot be used other than by the person named on the voucher.   25. The judge's decision is final and binding on the Participants. No correspondence will be entered into.
  26. The Promoter accepts no responsibility for contributions that are incomplete, illegible, lost or damaged.
  27. By entering, the Participant agrees to allow the free use of their names, photographs and general location for publicity and news purposes during this and future promotions by the Promoter if their story is published.
  28. Submission of a story will be deemed acceptance of these terms and conditions.
  29. The Promoter reserves the right at any time to cancel, modify or supersede the Promotion without prior notice or compensation.

    1. All conditions, warranties, and other terms which might otherwise be implied; and
